KAPITAL DESIGN EMPORIUM: Terms & Conditions

1. Introduction
Welcome to Kapital Design Emporium (“we”, “us”, “our”), the curated retail offering jointly operated by:

  • Christopher de Bod Designs (Pty) Ltd, Registration Number 2018/604884/07
  • Measure Pro (Pty) Ltd, Registration Number 2016/003784/07

Measure Pro (Pty) Ltd is the invoicing entity for all transactions, and Christopher de Bod Designs (Pty) Ltd is responsible for curation, design, and store operations.

These Terms & Conditions (“Terms”) govern your use of our website [WWW.CHRISTOPHERDEBOD.COM] and any purchase made through it. By using the website and/or placing an order, you agree to these Terms.

2. Products and Descriptions
We aim to describe products accurately, including dimensions, materials, and colours. Images are for illustrative purposes; actual goods may vary slightly due to manufacturing processes or screen display differences.

3. Ordering and Contract Formation
When you place an order, you make an offer to purchase. A binding contract is formed when we issue an order confirmation email. We reserve the right to refuse or cancel orders, for example, where stock is unavailable or pricing errors occur.

4. Prices, Taxes, and Payment
All prices are in South African Rand (ZAR) and include VAT where applicable. Payments must be made via the secure payment methods shown at checkout. We use third-party payment processors; their terms also apply.

5. Delivery and Risk
We will deliver goods to the address provided at checkout. We may ship directly from suppliers or items may be shipped by suppliers on our behalf. A reasonable delivery time frame of between three and seven days should be allowed for delivery of items.

Risk and ownership of goods transfer to you on delivery. Some products may be shipped directly from our suppliers (“dropshipped”). In such cases, delivery terms may vary.

 

6. Returns and Cancellations
Our returns process complies with:

  • Consumer Protection Act 68 of 2008 (CPA) – six-month implied warranty for defective or unsafe goods.
  • Electronic Communications and Transactions Act 25 of 2002 (ECTA) – limited “cooling-off” rights for certain online purchases.

For defective or unsafe goods, you may request a repair, replacement, or refund within six months of delivery. For qualifying online purchases, you may return the item within 7 days of receiving it, provided it is in its original condition (see full Returns Policy for further details).

7. Change-of-Mind Returns
We are not obliged to accept change-of-mind returns, but may do so at our discretion. Such returns must be in original condition and packaging. You may be responsible for return shipping and a restocking fee.

8. Privacy and Data Protection
We process personal information in accordance with the Protection of Personal Information Act (POPIA). For details, see our Privacy Policy.

9. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Any disputes will be subject to the exclusive jurisdiction of the South African courts.
